FreightCoreTMS LLC, operating as OverSizeTMS ("we," "us," or "our"), provides the OverSizeTMS transportation management platform. By creating an account or accessing OverSizeTMS ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
OverSizeTMS is a cloud-based transportation management system designed specifically for oversize and heavy haul trucking operations. Features include load and permit management, dispatch, invoicing, carrier and vendor management, equipment tracking, driver settlements, and SMS-based driver notifications. The Service is provided on a subscription basis to authorized tenants.
Access to OverSizeTMS requires a valid account provisioned by your company administrator. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify your administrator immediately if you suspect unauthorized access.
OverSizeTMS sends automated SMS messages to drivers and personnel who have provided a mobile phone number during registration. By providing your phone number, you consent to receive text messages related to your dispatch assignments, load status updates, detention clock alerts, and other operational notifications.
Message types: Load assignments, pickup/delivery reminders, detention billing alerts, and status update requests.
Message frequency: Varies based on active dispatch activity. You may receive multiple messages per day during active loads.
To opt out: Reply STOP to any message. You will receive one final confirmation and no further texts will be sent.

Rates: Message and data rates may apply. Check with your wireless carrier for details.
Carriers: Available on all major U.S. wireless carriers. Delivery is not guaranteed on all networks.
SMS messaging is powered by Twilio. By using the Service, you also agree to Twilio's messaging policies. Opting out of SMS does not deactivate your account — you may still receive in-app notifications.

OverSizeTMS collects operational data necessary to provide the Service, including load records, personnel contact information (including mobile numbers), and dispatch history. This data is stored securely and is not sold to third parties. Driver phone numbers are used solely to deliver dispatch-related SMS notifications described in Section 3. OverSizeTMS is offered on a paid subscription basis. Pricing is as published on oversizetms.com. Subscriptions renew automatically unless cancelled before the renewal date. Fees are non-refundable except where required by law. We reserve the right to modify pricing with 30 days' notice to active subscribers.
We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages, or force majeure events may cause temporary unavailability. We are not liable for losses resulting from downtime.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREIGHTCORETMS LLC (OPERATING AS OVERSIZETMS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.
We may suspend or terminate accounts that violate these Terms. You may cancel your subscription at any time through your account settings. Upon termination, your data may be deleted after a 30-day retention period.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
We may update these Terms from time to time. We will notify active subscribers by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
